Smile Studios, LLC – Terms and Conditions

By booking an appointment with Smile Studios, LLC (“Smile Studios,” “we,” “our,” or “us”), you (“Client” or “you”) agree to the following Terms and Conditions. These terms are designed to protect both parties and ensure a smooth, safe, and respectful experience for all.

1. Booking and Deposit Policy

  • A $15 non-refundable deposit is required to reserve your appointment. This deposit will be applied to your total service cost at the time of your visit.

  • If you cancel within 12 hours of your scheduled appointment or fail to show up for your appointment (“no-show”), your deposit will be forfeited and will not be applied to a future service.

  • Clients may reschedule appointments without penalty provided they do so at least 12 hours in advance.

2. Acknowledgement of Service Nature

  • By scheduling an appointment, you acknowledge that Smile Studios provides cosmetic Teeth Whitening Services only. These services are not dental care and are not administered by licensed dentists.

  • No examination, diagnosis, or treatment of dental or oral conditions will be provided. You acknowledge that you have been advised to consult with a licensed dentist prior to undergoing teeth whitening procedures.

3. Consent to Treatment and Assumption of Risk

By receiving services from Smile Studios, you confirm and accept the following:

  • You voluntarily consent to undergo cosmetic teeth whitening at Smile Studios and understand that results will vary based on individual factors.

  • You understand that no guarantee or assurance has been made regarding specific whitening outcomes or shade improvement.

  • You acknowledge that alternative options, such as professional whitening by a licensed dentist or over-the-counter treatments, are available and have been considered.

4. Potential Risks and Side Effects

You acknowledge the following possible side effects and risks associated with teeth whitening, including but not limited to:

  • Temporary tooth sensitivity, gum tenderness or inflammation

  • Dry or chapped lips

  • Soft tissue irritation, especially on the gums

  • In rare cases, damage to tooth pulp with frequent exposure to LED light

  • Possible allergic reaction to whitening agents

  • Inability to exactly match the shade of dental restorations (e.g., crowns, veneers)

  • Aesthetic changes in existing dental work over time

You accept these risks and agree that Smile Studios is not liable for any adverse effects resulting from the procedure.

5. Client Eligibility and Responsibilities

By booking, you confirm the following:

  • You are 18 years or older, or the parent/legal guardian of a minor age 16 or older receiving treatment with your consent.

  • You do not have significant gum disease, untreated cavities, broken fillings, chipped teeth, or other active dental issues. You agree to disclose any such conditions to your technician.

  • You understand that restorative dental materials (e.g., veneers, porcelain) will not respond to whitening and may not match your natural teeth post-treatment.

  • If you are pregnant or lactating, you acknowledge that you have been advised to consult with a doctor prior to undergoing teeth whitening procedures, that you assume all risks, and have notified your technician in advance.

6. Liability Waiver

To the maximum extent permitted by law:

  • Smile Studios, LLC, its owners, agents, and technicians shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the services provided.

  • You waive any claims and release Smile Studios, LLC from liability for any discomfort, injury, or dissatisfaction arising from or related to the procedure.

7. Dispute Resolution and Arbitration (California)

Binding Arbitration Agreement:

You agree that any and all disputes, claims, or controversies arising out of or relating to your use of Smile Studios services, these Terms and Conditions, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively and finally through binding arbitration in San Diego County, California, in accordance with the California Arbitration Act (Cal. Civ. Proc. Code §§ 1280 et seq.).

  • The arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) or any other mutually agreed-upon arbitration provider.

  • The arbitrator shall have the authority to award any relief available in a court of law, including injunctive and equitable relief.

  • Each party shall bear its own legal fees and costs, unless the arbitrator awards otherwise.

  • You waive your right to a jury trial or to participate in a class action.

This clause does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent immediate and irreparable harm.

8. Modifications and Updates

Smile Studios reserves the right to update or amend these Terms and Conditions at any time. Any changes will be posted on our website or communicated to clients directly.
